Ridgeline Signal — Subscription Terms of Service

0. About these terms
These Terms of Service ("Terms") govern your subscription to and use of Ridgeline Signal ("Signal", "the Service"), a Western Australian wholesale-energy-market intelligence service provided by Ridgeline Advisory (ABN 81 335 231 816) ("Ridgeline", "we", "us"). By starting a trial, subscribing, or accessing Signal you ("you", "the Subscriber") agree to these Terms. If you are agreeing on behalf of an organisation, you warrant you are authorised to bind it, and "you" means that organisation.
These Terms incorporate our Privacy Policy (available on request at mattcronin@ridgelineadvisory.com) and the Data Sources & Licences notice published in-product (/data-licences).
Service providers. Ridgeline uses trusted processors to operate Signal: authentication is provided via Supabase; payments are processed by Stripe (your card details are captured and stored by Stripe and never touch Ridgeline's systems); transactional email is sent via Resend. Their handling of your information is described in the Privacy Policy.
1. The Service — what Signal is, and what it is not
Signal provides market intelligence and analysis on the Western Australian Wholesale Electricity Market (WEM) and related gas, capacity, regulatory and new-build-pipeline information, derived from public sources and presented through periodic briefings, dashboards, alerts and asset-specific lenses.
1.1 Market intelligence, not financial, trading or investment advice — please read
Signal provides market intelligence and analysis derived from public sources for general information only. It is not financial product advice, investment advice, or a recommendation to make any trading, bidding, hedging, investment or commercial decision, and it does not consider your objectives, financial situation or needs. Except where a figure is explicitly labelled "sourced," figures are estimates, derivations or heuristics, may contain errors, and are no substitute for your own analysis and professional advice. To the maximum extent permitted by law, Ridgeline Advisory accepts no liability for any loss arising from reliance on Signal. Your decisions are your own.
Signal is not a licensed financial service and Ridgeline does not hold, and is not required by these Terms to hold, an Australian Financial Services Licence in providing it. Nothing in Signal is an offer, solicitation, or inducement to buy, sell, bid or hedge any energy, financial product, or capacity.
1.2 Provenance labelling
Signal labels the basis of its numbers — sourced (taken directly from a cited public source), derived (computed from sourced inputs by a documented method), or heuristic (an estimate or assumption). You agree to read and rely on these labels: a derived or heuristic value carries the uncertainty described in the in-product methodology and must not be treated as an authoritative or sourced figure.
1.3 Methodology and known limitations
Signal publishes its methodology and known limitations in-product, including where a modelled figure is presented as a bounded range or conservative lower bound rather than a point estimate. That published methodology — including any honest limitation or partial validation result — forms part of the Service description, and your subscription is on the basis that you have access to it.
2. Subscriptions, tiers and trials
2.1 Tiers. Signal is offered on the tiers published at ridgelineadvisory.com/pricing (currently Community, Professional, Government & Agency, and Enterprise). Your entitlements — which modules, asset lenses, seats and features you may access — are set by your tier. Community and Professional include one asset lens (selected in-product); Government & Agency and Enterprise include all lenses, with Enterprise adding API access and the pipeline-impact module.
2.2 30-day free trial. Self-serve subscriptions (Community, Professional) begin with a 30-day free trial. A valid payment method is captured at signup (held by Stripe) but not charged during the trial. Unless you cancel before the trial ends, your subscription converts automatically to a paid subscription at the then-current price for your selected tier, and your payment method is charged from the first day after the trial. You can cancel at any time during the trial via the billing portal, at no charge. One trial per organisation. We may require verification before or during a trial.
2.3 Free and concessional access. Free access is available to verified Traditional Owner corporations, Prescribed Bodies Corporate (PBCs) and First Nations community members, consistent with the same broad grant offered on Ridgeline Radar. Application is made at signup; verification is a short manual step; no payment method is required for approved concessional accounts. We may withdraw concessional access where eligibility is not established or no longer applies.
2.4 Seats and access. You are responsible for keeping account credentials secure and for all activity under your account. Access is per-Subscriber and per-tier; you must not share seats or credentials beyond your entitlement or provide access to third parties except as your tier expressly permits.
3. Fees, payment, GST
3.1 Fees. You agree to pay the fees for your tier, as charged through Stripe (self-serve) or as invoiced (organisational subscriptions). Prices are in Australian dollars. Where GST applies it is added at checkout and shown before you pay; Ridgeline will issue a receipt/tax invoice.
3.2 Billing cycle. Subscriptions are billed in advance, monthly or annually as selected (or as set out in your order/invoice). Enterprise and Government & Agency subscriptions may be invoiced annually or quarterly under a separate order form, which prevails over these Terms to the extent of any inconsistency.
3.3 Changes to fees. We may change fees on not less than 30 days' notice, effective from your next renewal. Continued use after a fee change takes effect is acceptance of the new fee.
3.4 Failed payment and grace. If a renewal payment fails, Stripe retries it automatically and we notify you by email. Your access continues unaffected for a 7-day grace period from the first failed attempt; if payment is not resolved by then, your account is suspended (past due) until payment succeeds. Reinstatement follows payment of outstanding amounts.
3.5 Taxes. You are responsible for any taxes other than taxes on Ridgeline's income.
4. Data sources, licences and provenance
4.1 Public sources. Signal is built on public data used under the licences its publishers grant, including: the Australian Energy Market Operator (AEMO) — WEM market data and the WA Gas Bulletin Board — used under AEMO's Copyright Permissions with attribution; the Economic Regulation Authority (WA) — determinations and regulatory documents, reproduced with acknowledgement of the source; and SILO climate data — Queensland Government, licensed under Creative Commons Attribution 4.0, derived from Bureau of Meteorology observations. Each figure in Signal cites its source; the current source list and attributions are maintained at /data-licences. No source or government body endorses Signal.
4.2 No warranty of source accuracy. Public source data may be incomplete, delayed, revised or withdrawn by its publisher. Ridgeline does not warrant the accuracy, completeness or timeliness of third-party source data and is not liable for errors originating in it. Where a source publisher revises data, Signal's derived figures may change.
4.3 Value-added product. Signal is a value-added analytical product, not a redistribution of any source dataset. You are licensed to use Signal's outputs for your internal business purposes only. You must not scrape, bulk-export, resell, sublicense, or redistribute Signal's data, briefings or outputs, or use them to build a competing product, except as expressly permitted by your tier (e.g. an Enterprise API entitlement) or agreed in writing.
5. Intellectual property
5.1 Ridgeline's IP. Signal, its software, design, methodologies, fused datasets, briefings, and the Ridgeline name and marks are owned by Ridgeline (or its licensors). These Terms grant you a limited, non-exclusive, non-transferable, revocable licence to access and use Signal for your internal business purposes for the subscription term — not any ownership.
5.2 Your data. You retain ownership of information you provide. You grant Ridgeline a licence to use it to provide and improve the Service. Ridgeline may use aggregated, de-identified usage data to operate and improve Signal.
5.3 Feedback. If you give us feedback, we may use it without restriction or obligation to you.
6. Confidentiality and client references
6.1 Each party will protect the other's confidential information and use it only to perform these Terms.
6.2 Client confidentiality. Ridgeline will not publicly identify you as a Signal subscriber without your consent. Any asset-specific analysis Ridgeline prepares for you references your own publicly available asset information; Signal's public and marketing materials use generic archetypes (e.g. coal, gas, battery, renewable), never named client relationships.
7. Acceptable use
You must not: (a) use Signal unlawfully or to breach the WEM Rules, market-conduct rules, or any AEMO/ERA obligation that applies to you; (b) attempt to gain unauthorised access to the Service or its sources, or circumvent access controls or source-provider access controls; (c) misrepresent a derived or heuristic figure as authoritative or sourced in onward communications; (d) share access beyond your entitlement; or (e) use Signal to develop a competing service. You remain solely responsible for your own market conduct, bids, trades and disclosures.
8. Availability, changes and beta features
8.1 No uptime guarantee (unless separately agreed). We aim to keep Signal available and current and to maintain the freshness of feeds, but except under a written service-level agreement we do not guarantee uninterrupted or error-free operation. We may perform maintenance and will use reasonable efforts to minimise disruption.
8.2 Evolving product. Signal is under active development. We may add, change or remove modules, lenses or features. We will not materially reduce the core entitlements of your paid tier during a paid term without offering a pro-rata credit or equivalent.
8.3 Beta/preview features may be offered "as is", may change or be withdrawn, and are excluded from any service commitment.
9. Disclaimers and limitation of liability
9.1 Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law ("ACL") or other law that cannot lawfully be excluded ("Non-excludable Guarantees"). This clause 9 applies subject to the Non-excludable Guarantees.
9.2 Limit for Non-excludable Guarantees. Where Ridgeline is liable for a failure to comply with a Non-excludable Guarantee in respect of services (and the services are not of a kind ordinarily acquired for personal, domestic or household use), Ridgeline's liability is limited, at its option, to re-supplying the services or paying the cost of having them re-supplied.
9.3 "As is" for the rest. Subject to clause 9.1, the Service and all outputs are provided "as is" and "as available", and to the maximum extent permitted by law Ridgeline excludes all other warranties, express or implied, including as to accuracy, fitness for a particular purpose, and merchantability.
9.4 Cap on liability. Subject to clause 9.1, and to the maximum extent permitted by law, Ridgeline's total aggregate liability arising out of or in connection with the Service and these Terms is limited to the fees you paid to Ridgeline for the Service in the 12 months before the event giving rise to the liability.
9.5 No indirect or reliance loss. Subject to clause 9.1, and to the maximum extent permitted by law, Ridgeline is not liable for any indirect, incidental, special or consequential loss, or for loss of profit, revenue, trading gains, anticipated savings, opportunity, or for any loss arising from any trading, bidding, hedging, investment or commercial decision made in reliance on Signal, even if advised of the possibility. This reflects clause 1.1: market intelligence, not advice; your decisions are your own.
9.6 Your acknowledgement. You acknowledge you have not relied on any representation not set out in these Terms, that energy-market outcomes are inherently uncertain, and that you are responsible for your own due diligence and professional advice.
10. Term, renewal, cancellation and suspension
10.1 Term and renewal. Your subscription runs for the period selected and renews automatically for successive like periods unless cancelled before renewal (or as set out in an order form). A trial converts per clause 2.2.
10.2 Cancellation by you. You may cancel at any time via the billing portal, effective at the end of the current paid period (or immediately and without charge during a trial); fees already paid are non-refundable except where required by the ACL or a Non-excludable Guarantee.
10.3 Suspension/termination by us. We may suspend or terminate for material breach (including non-payment per clause 3.4, or prohibited use) not remedied within a reasonable notice period, or immediately where required by law or to protect the Service or a source licence.
10.4 Effect. On termination your access ends. Clauses that by their nature survive (1.1, 4, 5, 6, 9, 11) survive.
11. General
11.1 Governing law. These Terms are governed by the laws of Western Australia, and the parties submit to the non-exclusive jurisdiction of its courts.
11.2 Changes to these Terms. We may update these Terms on reasonable notice (e.g. by email or in-product notice); material changes take effect at your next renewal, and continued use after they take effect is acceptance. The current version is always published at signal.ridgelineadvisory.com/terms.
11.3 Assignment. You may not assign these Terms without our consent; we may assign to a successor of the Ridgeline business.
11.4 Entire agreement. These Terms (with the Privacy Policy, Data Sources & Licences notice, and any order form) are the entire agreement and supersede prior discussions. An order form prevails over these Terms to the extent of any inconsistency.
11.5 Severability & waiver. If a provision is unenforceable it is severed to the minimum extent; a waiver must be in writing.
